Charges have been dismissed for a driver who permanently injured a man after the suspect died in a crash over the weekend.

Over a year ago a year since we introduced you to 24 year old austin brush -- after he was hit by an alleged drunk driver -- he couldn't walk for months.

Now..

The charges against nickolas white, the man accused of hitting him, have been dropped.

Kezi 9 news reporter emma jerome spoke with brush today about what he calls a "bizarre" situation "i have pain all the time, even when i'm not walking but especially when i try to get around" over a year ago austin brush was in the hospital unsure if he'd ever walk again after being pinned between two cars when an elleged drunk driver hit one in the whiteaker -- today he can walk -- but the man who hit him had his charges dismissed "i feel like this is the the second worst way things could have possibly gone, next to him getting away scot free.

" nickolas white was indicted on monday for reckless driving, duii, and assault... the twist was that two days earlier he was killed in a single vehicle motorcycle crash emma jerome: "this isnt where austin's story began but this is where it drastically changed when a drunk driver crashed into a car pinning austin to his leaving him injured indefinitely.

Now the person who hit him e is dead but austin says it still doesnt feel like justice!"

He says all he can do is wonder what would have happened if the da moved the case along quicker ab: "maybe he'd still be alive.

Maybe his family wouldn't have to grieve maybe i could have some real justice instead of just whatever this is."

According to david mintz the prosecutor on the case nickolas white was indicted by a grand jury on october 22 however he died october 24th and the charges weren't filed until the 26th along with a motion to dismiss them "yeah.

I don't know what to make of that still."
