A bill currently before the Kentucky Senate that some say is an attempt to get rid of the Franklin county circuit court
Justice of kentucky's supreme court did not mince words with lawmakers looking to push through a bill he says is nothing more than an attempt to get rid of the franklin circuit court.
Fs img txt bullets:no house bill 3 involves franklin circuit court gavel.jpg - other circuit judges hea ... chief justice john d minton junior appeared before the senate judiciary committee this morning to speak on house bill three, the bill would create three new judicial districts and require the chief justice to randomly select a new circuit judge from across the state to hear cases involving the state government and the kentucky constitution.
Those cases are typically heard in the franklin circuit court by two circuit judges.
Supporters say the current system prohibits those in the rest of the state from having their lawsuits heard by the judges they elected to circuit courts.
However... opponents say it is a power grab by g-o-p lawmakers and attempt to bypass a circuit court that has often ruled against them.
Minton says... if the bill passes... it would shift cases all over the state and upend the work of judges in all 120 counties.

Milton jr.: "the reason i really wanted to crawl out of bed and come here today is to tell you that tis is an egregious, egregious invasion the separation of powers.
Number of lawyers that signed on as sponsors to this bill would advocate a proposition that is legally so unsound.

It's not to get rid of franklin circuit court, as you've said, it's to get these special kinds of hearings out of franklin circuit court because that makes it a super jurisdiction."
