Chris Philp has called for different guidelines around non-crime hate incidents.
The shadow home secretary warned that officers should not be wasting time and resources by "policing thought".
"I would like to see the police concentrating on actual criminality rather than policing thought and the police should only pay attention to things that are not criminal if there is a real and imminent danger and escalation of behaviour," he said.
