Attorney General is suing the Governor again for closing private schools claiming it violates the first amendment

### in an effort to open private schools today...the attorney general and other schools across the state..are filing a lawsuit.

### ### classrooms are closing again... but attorney general daniel cameron wants private schools back open monday...the day all schools are ordered to stop in-person learning.

Cameron is suing...joining a filing by danville christian academy...in an effort to keep religious schools open.

Cameron previously lost a lawsuit against governor beshear when the kentucky supreme court ruled the governor has the power to issue emergency executive orders related to covid- 19.

Sot: 4:31 "this is sort of the next step in the process or the next kind of case which is not challenging whether the governor has the basic power but in exercising it, he's violated the fundamental rights of these particular schools and the individuals who want to attend them or teach at them."

The highlands latin school on frankfort avenue in louisville...along with at least a dozen others...filed a motion saturday to also join the lawsuit.

It claims the governor's order violated the first amendment and kentuckys religious freedom and restoration act.

U of l brandeis school of law professor sam marcosson says the governor will need to prove in this case...the latest order doesn't single out religion or burden religion unnecessarily.

In a statement...the governor responded to the lawsuit saying "the attorney general should stop playing politics and instead help kentuckians understand what it takes to defeat this virus."

Marcosson says he expects a judge to issue a ruling quickly.
